Law and Justice from an Evolutionary Perspective
ABSTRACT
The focus of this conference was on Garrett Barden and Tim Murphy's book, Law and Justice in Community. In the book, the authors offer a conception of law that emphasized that the fundamental institutions of law evolved in a natural way, and that law is not necessarily state law. This conception of law views law neither as an ideal universal code (i.e., the natural law school conception) nor as the commands of the sovereign (i.e., the positivistic conception).
